    "Vulneración del derecho a la salud para Mujeres Transexuales”

    This research presents a comparative legal study on the right to access hormone treatments for transgender women in Ecuador, Argentina, and Uruguay during the period 2020-2024. The analysis examines the regulatory frameworks, relevant case law, and public policies that require access to these necessary treatments within the public health systems of the three countries, recognizing inequalities in their effectiveness and implementation. A qualitative methodology with a legal-comparative approach is used, based on a documentary study [Gender Identity Law of Argentina (2012), the Comprehensive Trans Law of Uruguay (2009), and Ecuadorian regulatory framework], relevant jurisprudence of each country and current health care protocols. Systematic comparison matrices were used to analyze the recognition of rights, access mechanisms, and guarantees of effective implementation in each context. The findings show that Argentina and Uruguay have established comprehensive legal frameworks that ensure access to hormone treatments, while Ecuador demonstrates significant structural deficiencies. Best practices and legal standards are identified in Argentina and Uruguay that reinforce the Ecuadorian normative framework, thereby contributing to the academic debate on the materialization of the right to health for the trans community. It is evident that, despite formal regulatory progress, barriers such as structural discrimination and the shortage of specialized health professionals persist. This issue is particularly serious in Ecuador where—despite constitutional guarantees on the right to health, non-discrimination, and gender identity—clear administrative procedures for exercising these rights are lacking.

    “El interés superior del niño en casos de tenencia: Análisis comparado de la jurisprudencia estadounidense y ecuatoriana (2018-2023)”

    This article analyzes the application of the best interests of the child principle in custody cases through a comparative study of Ecuadorian and U.S. jurisprudence between 2018 and 2023. A qualitative methodology with a legal-comparative approach is applied to identify similarities and divergences in the judicial evaluation of factors such as the child's emotional stability, parental bonds, participation in proceedings, and the role of mediation. In the United States, the best interests of the child doctrine allows for a flexible, context-driven interpretation focused on family dynamics and parental suitability. In Ecuador, although the principle is enshrined constitutionally, judicial interpretation remains inconsistent. The comparative analysis reveals meaningful progress in both systems, alongside challenges for a coherent and child-centered application of the standard. The article concludes with recommendations aimed at strengthening effective judicial protection of children's rights in custody-related disputes.

    “Análisis de los criterios judiciales para la valoración del daño psicológico en sentencias de violencia contra la mujer en Quito (2020-2024)”

    Psychological violence in the city of Quito is one of the most serious problems affecting women, manifested through attitudes and behaviors to manipulate, control, cause emotional damage, and induce psychosomatic issues—consequences that are profound and, unfortunately, often become long-lasting. Therefore, this research aimed to analyze the judicial criteria for the valuation of psychological damage in cases of violence against women. Through qualitative research and the application of documentary and systematic study of court rulings, it was determined that expert psychological reports serve as essential evidentiary tools to achieve justice and comprehensive reparation for victims of psychological harm. It is essential to have appropriate judicial criteria to evaluate the psychological damage, which is crucial for judges to implement appropriate reparation measures. The reports are essential to address the emotional sequelae and help victims to rebuild their lives after the abuse they have suffered.

    “Análisis de deficiencias motivacionales en las sentencias de primera y segunda instancia del caso Río Blanco bajo el test constitucional de motivación (2018-2023)”

    This paper examines the legal arguments presented by judges in Ecuador regarding the principle of free, prior, and informed consent (FPIC). It analyzes the legal statements and reasoning given in the Río Blanco case rulings, which exhibit several motivational deficiencies related to international standards established within the international legal framework. Using a qualitative, documentary-analytical approach and applying the jurisprudence of the motivational deficiency test, motivational flaws such as insufficiency, incoherence, and irrelevance are identified. In the first instance, for example, the cultural identity of the parties invoking this right was not verified, nor were the documents verified with data and analysis. In the second instance, another argumentative element unrelated to the case and legal issue was introduced, affecting the consistency of the decision. These deficiencies in the reasoning behind the judgments compromise the legitimacy of the FPIC and generate inadequate legal rationale.

    “Regulación jurídica del sicariato juvenil en Ecuador: Análisis de sus deficiencias y alternativas de mejora desde una perspectiva comparativa”

    This study analyzes legal deficiencies in Ecuador regarding juvenile homicide, a phenomenon that is intensifying due to the use of minors by criminal groups. Ecuador's legal system, established in the Code of Children and Adolescents, is limited to implementing insufficient socio-educational measures to penalize serious crimes. Through a comparative study with the laws of Mexico and Spain, legal models have been identified that balance appropriate penalties with the safeguarding of children's rights. This study, employing a qualitative and comparative legal method, analyzes the laws, jurisprudence, and doctrine of the three countries, highlighting best practices that could be implemented in Ecuador. According to these publications, legal reforms are proposed that would establish stricter sanctions and extraordinary instructions in cases of contract killings involving adolescents, simultaneously attesting to the best interests of the adolescent, their restitution, and social protection. The goal of this study is to strengthen the discussion about the criminal responsibility of young people and suggest new opportunities for organized crime in Ecuador.

    “Análisis comparativo Ecuador-Argentina sobre la eficiencia del derecho penal en la protección de la propiedad intelectual: propuesta de reforma al artículo 208A del COIP”

    This study examines the criminal protection of intellectual property in Ecuador, specifically through Article 208A of the Comprehensive Organic Criminal Code (COIP, by its Spanish acronym). It draws a comparison with Argentine legislation to identify shortcomings in Ecuadorian regulations, such as a lack of precision in key concepts and difficulties in prosecuting these offenses criminally. Using a comparative analysis, the research examines Argentina's legal framework, its sanctions, and complementary approaches. It enabled the development of a proposed reform for Article 208A of the COIP, primarily focused on clarifying the concept of “commercial scale," strengthening the proportionality of penalties, and enhancing criminal prosecution through specialized mechanisms. The study concludes that this reform would enable a more effective and equitable application of the law, distinguishing between occasional infringers and organized criminal structures. Moreover, it emphasizes the importance of enhancing the training of justice operators and fostering international cooperation. The main contribution of this study is to offer a concrete proposal to optimize Ecuadorian intellectual property regulation, fostering a balance between intellectual property protection and legal certainty

    The Ecuadorian penitentiary system is undergoing a deep crisis characterized by uncontrollable cases of violence and murders that have extended beyond prison walls, spreading fear throughout society and manifesting in extreme violence within the prisons. The research will focus on analyzing the causes of this problem and its impact on the violation of the right to personal integrity of the persons deprived of liberty (PDL) at the Social Rehabilitation Center of Cuenca. Through qualitative research with a descriptive-analytical approach, and based on a documentary review of legal doctrine, jurisprudence, and scientific evidence, this study aims to identify not only the causes of violence but also the shortcomings of the prison and social rehabilitation system at regional and national levels. Finally, as a contribution, it proposes improvements to the comprehensive protection measures for PDL that limit the cases of intra-prison violence to make the penitentiary system more efficient and safe.

    This paper focuses on the legal analysis of the conflict that arises when an individual is obligated to pay child support but suffers from a catastrophic illness that prevents them from fulfilling that responsibility. This conflict centers on the need to balance the child’s right to receive support with the rights of the supporter, who, due to a serious illness such as cancer, is unable to generate income to meet their child support obligations. The Constitution recognizes the rights of minors and the rights to health and life of the supporter. Ecuadorian legislation, including the Code on Children and Adolescents and the Constitution of the Republic of Ecuador, will be analyzed in relation to the best interests of the child, the rights of vulnerable individuals, and the need to protect persons with catastrophic illnesses who may be unable to fulfill their financial responsibilities, to determine an appropriate legal solution to issue.

    Digitalization in the Ecuadorian financial sector has increased risks to personal data protection, as evidenced by cyber-attacks and deficiencies in the enforcement of the Organic Law for the Protection of Personal Data (LOPDP, by its Spanish acronym). Persistent gaps in cybersecurity, infrastructure, and staff training comprise safeguarding sensitive information within the financial sector. This research aims to evaluate the risks and vulnerabilities in data protection in financial institutions since the LOPDP came into force, to assess its implementation level, and to propose measures to ensure the comprehensive protection of citizens’ constitutional rights over their data. The study employed a qualitative approach through the review of regulations, jurisprudence, and legal doctrine, as well as a comparative law analysis. The findings reveal gaps in the implementation of security measures, which are reflected in the exposure of sensitive data and limitations in regulatory compliance. Therefore, there is an urgent need to optimize existing control procedures and the respective technological updates to ensure adequate protection. In conclusion, it is recommended that strategies such as mandatory audits, technological modernization, and digital education be implemented to strengthen data integrity and confidentiality in the Ecuadorian financial sector.
