However, this innovation carries significant risks that threaten fundamental principles such as honor and good reputation, which, as they are linked to human dignity, significantly affect people’s reputations through insults and false accusations. The circulation of personal information on virtual platforms can lead to emotional consequences such as stress, depression, and decreased self-esteem. As a result, several countries, including Ecuador and Spain, have developed legal regulations aimed at protecting the privacy, honor, and personal integrity of citizens. These regulations establish protection and redress mechanisms that seek to restore peace of mind to the victim. Protection and redress mechanisms include corrective measures, such as compensation and the removal of malicious content that may affect privacy and personal integrity, aimed at raising awareness and promoting digital responsibility within society. This increase has caused delays that compromise the principles of procedural speed and economy. Although conciliation is constitutionally recognized, its use in executive proceedings for bills of exchange is limited, largely due to diverse barriers that impede its practical implementation. This study aimed to identify and characterize the legal, procedural, and institutional barriers that limit the application of conciliation in executive proceedings for bills of exchange. This process was developed by analyzing regulations and sentences to propose improvement actions that optimize its utilization. The research was developed under a qualitative approach as it was theoretically grounded in conciliation and the barriers to its application, using documentary and content analysis techniques. As a result of the analysis of 20 sentences, various barriers to the application of conciliation in the executive proceedings were identified. Additionally, as a contribution, it was established that a study should be conducted by the Council of the Judiciary for the implementation of rooms or cubicles with trained conciliators in the different parishes of Azogues.Item type: Ítem , Access status: Acceso Abierto , Análisis de la compatibilidad constitucional de la Ley Orgánica de Inteligencia del Estado Ecuatoriano (2025) con el derecho fundamental a la intimidad(Universidad Católica de Cuenca, 2025) Chica Pauta , Sue Fernanda; Palacios Rodas , Cristian Andrés; 0106787617This research analyzes the constitutional compatibility of the Organic Law on Intelligence of the Ecuadorian State (2025) with the fundamental right to privacy, using a qualitative methodology of normative-constitutional analysis. The study examines the configuration of the right to privacy in the 2008 Ecuadorian Constitution and its development in case law, evaluates international standards of protection against intelligence activities, and applies the proportionality test to the law’s most controversial provisions. The results demonstrate significant structural tensions between the powers of communications interception and constitutional guarantees of privacy. The application of the proportionality test reveals that the regulations do not exceed the sub-principles of necessity, suitability, and strict proportionality, while establishing mechanisms for direct access to institutional databases that prioritize operational efficiency over constitutional safeguards. Comparative analysis highlights institutional deficiencies relative to standards developed by other Latin American and European legal systems. In this regard, this paper analyzes the dogmatics of the interspecies principle through the study of Sentence No. 253-20-JH/22 of the Constitutional Court of Ecuador. The main objective is to analyze the doctrinal basis of the interspecies principle in light of the legal criterion of the previously cited sentence. The methodology of this study was based in a qualitative approach, which analyzes a set of conceptual, dogmatic, and doctrinal particularities that contribute to generating an understanding of the main parameters in which the construction of the criteria emitted in this study is elucidated. The results and conclusions allow for the determination that it is important to effectively elucidate the rights corresponding to non-human animals, establishing guidelines that contribute to promoting actions for the conservation, preservation, and maintenance of life. The general objective of this research is to analyze the legal status of ancestral marriage within the Ecuadorian constitutional framework, identifying normative gaps and evaluating international standards and comparative law. The methodology used was qualitative, documentary, and doctrinal, supported by an analysis of doctrine, national and international regulations, Constitutional Court jurisprudence, and pronouncements of the Committee on the Elimination of Racial Discrimination (CERD). The results show that the Ecuadorian State maintains an exclusionary normative framework that only recognizes marriages formalized before the state (colonial) authorities, disregarding indigenous peoples' own legal institutions and affecting rights such as cultural identity, family reunification, and social protection.
