Análisis de la eficacia de las medidas socioeducativas aplicadas a menores infractores por delitos sexuales en La ciudad de Cuenca

Abstract

This study analyzes the issue of the effectiveness of socio-educational measures applied to adolescents responsible for sexual offenses in Cuenca. The study examines whether the Ecuadorian legal framework of Juvenile and Criminal Law provides sufficient tools to achieve the comprehensive rehabilitation of the offender while simultaneously ensuring restorative justice and effective protection for the victims. Likewise, the real impact of the reeducation and social reintegration programs aimed at these adolescents is evaluated. The hypothesis suggests that the results are limited due to high rates of recidivism and still insufficient specialized supervision within the juvenile justice system. Therefore, the research aims to identify operational and legal shortcomings that hinder the effective implementation of these measures. Finally, adjustments aimed at strengthening rehabilitation processes are proposed, improving institutional monitoring, and ensuring the comprehensive protection of the rights of individuals affected by these types of behaviors, while also promoting more effective public policies for prevention, care, and social reparation in the local context. This contributes to the strengthening of the Ecuadorian juvenile justice system and to a more humane, responsible, and sustainable response to these social issues.
