| dc.description | El procedimiento monitorio, implementado en el "Código Orgánico General de Procesos (COGEP)", plantea la posibilidad de someter a un proceso judicial de cobro, ciertas deudas, que constan en documentos, que, aunque no cumplen con las características rigurosas de un título ejecutivo representan derechos personales. El problema planteado en esta investigación, es la poca credibilidad que se le da al documento base de la obligación, frente a un juez, a pesar de lo establecido en el Art. 356. Núm.1 del COGEP. Se utilizan como métodos la revisión de la doctrina y la observación de la casuística relacionada al artículo en cuestión, con lo que se demuestra la poca aceptación que se les da como pruebas, llegándose a postular la necesidad de fortalecer su capacidad probatoria, mediante pruebas suplementarias tanto documentales como testimoniales. | es_ES |
| dc.description.resumen | The monitory procedura implemented in the "Código Orgánico General de Procesos (COGEP), proposes the possibility of summiting to a judicial collection procedure certain debts which are supported in written documents, and regardless they do not comply with the strict characteristics of an executive title, they represent personal rights. The problem outlinde in this investigation is the little credibility that the base document of the obligation has, in front of a judge, in spite of what is stablished by the Art. 356 Num.1 of the COGEP. The methods to be used are the doctrine review and the observation of the available cases related to the article in question, to demonstrate the little acceptance they have as evidence, getting to the postulation that an improvement in their support strength as evidence it´s needed, through supplementary written and testimonial evidence. | es_ES |
