Resumen
The purpose of this research is to analyze the criminalization to which the indigenous people and indigenous leaders of the Tukayta Organization "Tukuy Cañar Ayllukunapa Tantanakuy" belonging to the Province, Parish and Canton Cañar were subjected for exercising their constitutional rights with actions in the social protests called by CONAIE in October 2019 due to the decisions of the government in office of Lenín Moreno to ratify Decree 883 which consisted of the "increase in the price of gasoline and Diesel", in such virtue it is necessary to analyze the precepts of the Inter-American Commission on Human Rights on the exercise of indigenous social protests and the violation of their human rights based on Article 66 numeral 6-13 and Article 98 of the Constitution of Ecuador that recognizes "the right to express opinions, express themselves, the right to associate, assemble, the right to demonstrate freely and voluntarily and the right to resistance against actions or omissions of the public power".

La presente investigación tiene como finalidad analizar la criminalización a la que sometieron a los dirigentes indígenas e indígenas de la Organización Tukayta “Tukuy Cañar Ayllukunapa Tantanakuy” perteneciente de la Provincia, Parroquia y Cantón Cañar por ejercer sus derechos constitucionales con acciones en las protestas sociales convocadas por la CONAIE en octubre del 2019 por las decisiones del gobierno en turno Lenin Moreno de ratificar el decreto 883 que consistía en la “incrementación del precio de la gasolina y el Diesel ”, en tal virtud es necesario el análisis de los preceptos de la Comisión Interamericana de Derechos Humanos acerca del ejercicio de las protestas sociales indígenas y la vulneración de sus derechos humanos en base al artículo 66 numeral 6-13 y el artículo 98 de la Constitución del Ecuador en el que se reconoce “el derecho a opinar, expresar, el derecho a asociarse, reunirse, derecho a manifestar de forma libre y voluntaria y el derecho a la resistencia frente a acciones u omisiones del poder público…”
