Resumen
This research analyzed the need to implement the telematics summons as an autonomous procedure to guarantee the right to effective judicial protection and due process. This study used the inductive-deductive methodology and the analytical-synthetic method to analyze from a dogmatic and theoretical perspective what refers to the telematics summons and its reform within the General Organic Code of Processes (COGEP by its Spanish acronym). The findings showed that the telematics summons is limited within the reform as far as the subpoena process is concerned, so it is necessary to implement an amendment that allows its autonomy, thus enabling compliance with due process and adequate judicial protection. In conclusion, establishing the procedural autonomy of the telematics subpoena reduces the time of the subpoena process. It automates certain activities within the judicial function, improving its operability and technical effectiveness.

El objetivo de este trabajo investigativo se centra en analizar la necesidad de implementar a la citación telemática como un procedimiento autónomo para garantizar el derecho de tutela judicial efectiva y el debido proceso. Se utilizó una metodología de tipo inductivo – deductivo, así como un método analítico – sintético para analizar desde una perspectiva dogmática y teórica lo referente a la citación telemática y su reforma dentro del Código Orgánico General de Procesos. Los resultados dieron a conocer que, la citación telemática se encuentra limitada dentro de la reforma en cuanto al proceso de citación se refiere, por lo que es necesario ejecutar una enmienda que permita su autonomía admitiendo así el cumplimiento del debido proceso y la tutela judicial efectiva. Llegando a la conclusión de que, establecer la autonomía procesal de la citación telemática disminuye el tiempo del proceso de citación, además automatiza ciertas actividades dentro de la Función Judicial mejorando su operatividad y efectividad técnica.
