Resumen
Divorce is judicial in nature and this is a necessary consequence of the principle of solemnity and publicity of the marriage, thus the requirement of its celebration with the intervention of public authority and so its dissolution is subject to them.
The figure of divorce by mutual consent, is a voluntary act where the full will prevails above all; being able to do it through a competent authority, or also
the Notary is fully empowered to perform this procedure; however, he or she has certain limitations.
It is important to analyze the respective Article 18 paragraph 22 of our notary code through the laws and different theories proposed by different authors,
which will allow us to determine if the Notary Public can fully process divorces by mutual consent when there are minor children, empowering them to resolve the situation of the minor

El divorcio tiene carácter judicial y ello es consecuencia necesaria del principio de solemnidad y publicidad del matrimonio, es así que el requisito de su celebración con intervención de autoridad pública y así su disolución está sujeta a los mismos.
La figura del Divorcio por mutuo consentimiento es un acto en donde prevalece sobre todo la voluntad plena; pudiendo realizarlo mediante autoridad competente, o también en la actualidad el Notario está plenamente facultado para llevar a cabo dicho trámite. Sin embargo, tiene ciertas limitantes.
Es importante analizar el respectivo artículo 18 numeral 22 de la ley notarial mediante las leyes y diferentes teorías propuestas por diferentes autores, que nos permitirá determinar si el Notario Público puede tramitar plenamente divorcios por mutuo consentimiento cuando existan hijos menores de edad, facultándolo para resolver la situación del menor de edad
