The central issue lies in the fact that, despite not serving an actual custodial sentence, the beneficiary remains subject to interdiction, which entails the suspension of fundamental civil and political rights. The main objective was to assess the compatibility of this measure with constitutional and international principles, particularly those related to rehabilitation, minimal criminal intervention, and proportionality. A qualitative methodology was employed, based on doctrinal, jurisprudential, and comparative normative analysis. As a result, it is concluded that interdiction in such cases lacks legal justification and violates human dignity. Therefore, it should be reformed to align with the rights-based model of the Ecuadorian state and the international commitments undertaken by the country.Item type: Publicación , Access status: Acceso Abierto , El principio de autodeterminación y sus fronteras jurídicas: tensiones entre la autonomía indígena y la justicia ordinaria ecuatoriana(Universidad Católica de Cuenca., 2025) Juank Wampiu, Jose Eduardo; Rodríguez Quinteros , David Gregorio; 1450109325This abstract synthesizes the study whose main objective was to analyze the legal tensions existing between the boundaries of the principle of self-determination of indigenous peoples and the Ecuadorian ordinary justice system. The analysis is based on the issues arising from the divergence between legal provisions and institutional practice, which limits the effective exercise of the self-determination rights of these peoples. A descriptive qualitative and analytical-conceptual methodology was employed, supported by the reading, interpretation, and classification of academic, normative, and jurisprudential sources, as well as the application of the analytical method to uncover the foundation of the principle, the inductive-deductive method to integrate national and international regulations, and the comparative method to contrast theory with state practice. The final results confirm that the constitutional and international legal framework is solid, but its implementation is hindered by problems within state institutional structures. Consequently, there is a clear need to harmonize secondary legislation with international standards in order to overcome structural obstacles that undermine the effectiveness of a plurinational and intercultural model concerning its objectives of self-determination as a guiding principle for these human groups, a principle that should also be protected by the national ordinary justice system.Item type: Publicación , Access status: Acceso Abierto , Análisis de la aplicación del criterio de interpretación intercultural en las decisiones sobre delitos contra el derecho a la propiedad emitidas por la Corte Provincial de Justicia de Morona Santiago desde el año 2024.(Universidad Católica de Cuenca., 2025) Mejía López, Deivid Adrian; Cando Shevchukova, Sergio Luis; 1401325269The present study aimed to examine the extent to which judicial decisions delivered since 2024 by the Provincial Court of Justice of Morona Santiago reflect an intercultural approach in the interpretation of crimes against property. A qualitative methodological approach was adopted, focusing on the documentary analysis of seven judicial cases processed during the 2024–2025 period. The main finding of this study is the absence of second-instance rulings that develop the criterion of intercultural interpretation in the reviewed cases. Four of the proceedings ended in withdrawal, while in the remaining cases, pre-trial detention was upheld on the basis of procedural risk, without incorporating differentiated analysis or other elements that provide sociocultural context. This lack of jurisprudence constitutes a significant finding, as it reveals potential institutional gaps in the production, publication, and visibility of judicial decisions that adopt an intercultural perspective in the province. It argues that the absence of judges with specific training has produced dispersed jurisprudential criteria and weakened legal certainty, hindering the uniform application of judicial guarantees. Through a legal-analytical and comparative-law approach, the study finds that judicial systems that set clear parameters for assigning specialized competencies—and that promote professional specialization—achieve a more consistent interpretation of the law. Building on this assessment, the article proposes for Ecuador a model of constitutional justice that combines technical rigor with effective territorial coverage through a tiered jurisdictional structure. It concludes that judicial specialization constitutes not only an institutional transformation, but also a key tool for structuring the exercise of judicial discretion and consolidating a coherent model of constitutionalism oriented toward the effective protection of rights.Item type: Publicación , Access status: Acceso Abierto , Optimización Financiera mediante modelos de gestión eficientes: Caso Constructora MACASCORP S.A.(Universidad Católica de Cuenca., 2025) Medina Gualpa, Cinthya Sabina; Carangui Velecela, Paola Alexandra; 1400520589The economic framework of the construction industry is conditioned by the volatility of raw material resources and the constant demand to meet quality standards. This reality underscores the need to implement robust and flexible financial management processes. Such challenges have limited the sector’s ability to make timely decisions, leading to project delays, cost overruns, and inefficient resource allocation. The purpose of this study was to develop a financial management model based on control mechanisms that provide reliable information to support sound financial and accounting decision-making. The applied methodology followed a mixed approach with an exploratory–descriptive scope, as existing documentation from the entity under study was reviewed to collect the necessary data and diagnose areas of weakness and risk. The findings revealed that the company operates in an environment characterized by more threats than opportunities. The absence of internal policies, weak risk management processes, and limited technological modernization were identified as the main sources of vulnerability that hinder the organization’s financial sustainability. Nevertheless, strengths were found in social and legal factors, where a culture of transparency and adherence to the code of ethics foster institutional trust and credibility.
