dc.descriptionEl presente articulo abarca un análisis normativo sobre el acceso a la salud en el IESS desde el primer día de afiliación, mediante el estudio del derecho a la salud en la normativa interna, jurisprudencia, doctrina y derecho comparado realizado por medio del método de investigación cualitativo analítico sintético e inductivo deductivo, así como la determinación de las limitantes a este derecho y como vulnerarían el derecho a la salud, este enfoque permite plasmar como en la Ley de Seguridad Social, la Disposición General Tercera de su Reglamento y la resolución C.D. 622 existe una distinción desproporcionada sin los criterios necesarios para evitar la violación de derechos. Los resultados evidencian como el Instituto Ecuatoriano de Seguridad Social impone tiempos extensos para acceder a la salud en contingencias de enfermedad en contradicción al respeto jerárquico de las normas, así vulnerando el derecho de acceso a los afiliados y faltando a la obligación que tiene el Estado para su ejercicio.es_ES
dc.description.abstractThis article covers a normative analysis on access to health in the IESS from the first day of affiliation, through the study of the right to health in internal regulations, jurisprudence, doctrine and comparative law carried out through the qualitative analytical synthetic and inductive deductive research method, as well as the determination of the limitations to this right and how they would violate the right to health, this approach allows to reflect as in the Social Security Law, the Third General Provision of its Regulations and the resolution C.D. 622 there is a disproportionate distinction without the necessary criteria to avoid the violation of rights. The results show how the Ecuadorian Institute of Social Security imposes long times to access health in contingencies of illness in contradiction to the hierarchical respect of the norms, thus violating the right of access to affiliates and lacking the obligation that the State has for its exercise.es_ES
