dc.descriptionEl objeto del presente trabajo está orientado al análisis de la práctica usuraria en el cantón Cuenca, las consecuencias jurídico-sociales que ha causado este injusto penal; toda vez que ataca al patrimonio de sus víctimas, como también del Estado. Se trata de un delito oculto y continuo por quienes hacen de esta práctica delictiva su modo de vida, sometiendo a sus incautas víctimas, quienes por su necesidad económica urgente acuden a préstamos fáciles y rápidos, estipulan por ello el pago de un interés sobre los porcentajes legalmente establecidos por el órgano regulador; porcentajes lucrativos en contraparte por el uso del capital recibido en calidad de préstamo, sin darse cuenta en el enredo financiero que han caído; y que, los deudores, a fin de cumplir sus obligaciones se han visto en la calamitosa necesidad de despojarse de todos sus bienes, quienes a más de ser atacado sus patrimonios, han sido víctimas de delitos conexos que por su naturaleza genera la usura. La normativa existente para reprimir este delito en poco ha aportado para aquello, según la investigación de tipo exploratoria que se ha realizado, específicamente al analizar los dos juicios de usura que se ha traído a colación en el presente trabajo; de los cuales, sus resoluciones ejemplarizadas han creado conmoción social, devolviendo así credibilidad de Justicia a quienes tanto lo han clamado por ser víctimas de usureros como de delitos conexos.es_ES
dc.description.abstractThis work aims to analyze the usury practices in the canton of Cuenca and its legal and social consequences as a criminal offense that impacts the assets of the victims and the State. Usury remains a concealed and ongoing crime, perpetuated by those who make this criminal practice their way of life, subjecting their unsuspecting victims, who, due to their urgent economic need, turn to easy and quick loans, agreeing to pay interest rates above the percentages legally established by the regulatory body—lucrative percentages in return for the use of the capital received as a loan. Unaware of the financial trap they have fallen into, debtors have found themselves in the dire necessity of divesting themselves of all their assets to fulfill their obligations. This makes them not only victims of usury but also of related crimes linked to this exploitative practice, which, by its nature, generates usury, attacking their patrimony. According to this exploratory research conducted, the existing regulation to curb this crime has contributed little to that effect, specifically when analyzing the two usury trials. The exemplary resolutions of these cases have caused a social commotion, thus restoring credibility to the justice system for those who have suffered as victims of usurers and related crimes.es_ES
