La importancia de actualizar la figura jurídica del patrimonio familiar en la Legislación Ecuatoriana

Abstract

The Constitution of the Republic of Ecuador recognizes the family in its various types, however, it has faced a delay concerning the civil field, since it does not consider, for example, equal marriage for the enjoyment of the benefit of the family patrimony, therefore, in the present work the objective was to determine the importance of modifying the legal figure of the family patrimony, through the law, which allows a regulatory harmony The with the advances of family law in the Ecuadorian legislation. To achieve this objective, a qualitative research approach was used, in addition to the use of inductive-deductive, dogmatic-legal, and historical-comparative methods. lt is concluded that the family patrimony does not go in the same way as the advances that have been made for family law in the Ecuadorian legislation, for this, reforms to the Civil Code are presented.
