dc.descriptionEn la actualidad, la legislación ecuatoriana reconoce la custodia monoparental para los hijos menores de edad, en caso que exista separación de sus padres; situación que restringe el goce de los derechos del niño y su desarrollo integral. Esta situación se solventaría con el reconocimiento legal de la custodia compartida, que tiene como finalidad materializar la corresponsabilidad parental y hacer efectivo el cumplimiento de los derechos de los niños, niñas y adolescentes. En la presente investigación se realiza un estudio legal y doctrinal de la Custodia Compartida en relación al Principio Jurídico del Interés Superior del Niño, utilizando el método inductivo-deductivo y analítico-sintético, tomando en cuenta su conceptualización, alcance e incidencia en el respeto y cumplimiento de los derechos del niño, niña o adolescente, con base en Instrumentos Jurídicos Internacionales y ordenamiento jurídico del Ecuador.es_ES
dc.description.abstractCurrently, in the Ecuadorian legislation, single-parent custody is recognized for underage children in the case of separation from their parents; this fact restricts the enjoyment of the rights of the boy or girl in their integral development. This situation would be solved with the legal recognition of shared custody, which aims to materialize the joint parental co-responsibility of the father and mother, and allows the fulfillment of the rights of children and adolescents. In this investigation, a legal and doctrinal study of shared custody is conducted concerning the Legal Principle of the Best Interest of the Child, using the inductive-deductive and analytic-synthetic method, taking into account its conceptualization, scope, and incidence in the respect and fulfillment of the rights of children or adolescents, based on International Legal Instruments and the Ecuadorian legal system.es_ES
