| dc.description | "El presente trabajo es un análisis de las causas que influyen en el cometimiento del delito de femicidio en la ciudad de Cuenca, para lo que se ha recopilado información bibliográfica y estadística que nos permita conocer el entorno, los antecedentes y la motivación que lleva al femicida a cometer este delito. Se ha revisado la Constitución de la República en su artículo 66 numeral 1 que se refieren al derecho a la vida como bien jurídico de rango constitucional, inalienable, consustancial al ser humano, el Código Orgánico Integral Penal en sus artículos 18 referente a la definición de infracción penal y 25 que hace alusión a la tipicidad, y concretamente el Art. 141 que trata del femicidio llamado también como feminicidio y el Art. 142 a sus agravantes. Se analizaron las sentencias de dos de los juicios más publicitados ejecutados uno en la ciudad de Guayaquil y otro en la ciudad de Cuenca, para verificar las bases jurídicas y doctrinarias en cuanto al femicidio desde un enfoque dentro del Derecho Penal e identificar si se cumple con los parámetros establecidos en la Constitución y en el Código Orgánico Integral Penal. | dc.description.abstract | "The present work is an analysis of the causes that influence the commission of the crime of femicide in the city of Cuenca, for which bibliographic and statistical information has been compiled that allows us to know the environment, the background and the motivation that leads to the femicide to commit this crime. The Constitution of the Republic has been revised in its article 66 numeral 1, which refers to the right to life as a juridical right of constitutional, inalienable, consubstantial nature to the human being, the Organic Integral Penal Code in its articles 18 referring to the definition of criminal offense and 25 that alludes to the typicity, and specifically Art. 141 that deals with femicide also called femicide and Art. 142 to its aggravating circumstances. We analyzed the sentences of two of the most publicized trials carried out, one in the city of Guayaquil and the other in the city of Cuenca, to verify the legal and doctrinal bases regarding femicide from an approach within Criminal Law and to identify if it is complied with. The parameters established in the Constitution and the Comprehensive Organic Penal Code. It is concluded that, in a high percentage of cases, femicide is generated by intrafamily violence, so it is recommended not only to repress this crime, but to implement prevention and protection measures, beyond a comprehensive reparation that is sometimes dead letter.
