dc.descriptionEl apremio personal por falta de pago de pensiones alimenticias es un tema muy controversial, constantemente se discute si los derechos del niño deben primar frente al de sus alimentantes, por ello en el presente artículo se analiza la reforma del artículo 137 del COGEP, a fin de establecer sus principales cambios, efectos, y la vulneración al principio del interés superior del niño, para ello la metodología que se ha empleado parte desde un enfoque cualitativo, basado en la fundamentación teórica , así mismo se utilizó los métodos inductivo-deductivo y comparativo, así también los recursos como normativa legal vigente, fuentes bibliográficas, teoría fundamentada, revistas, libros y una encuesta de tipo no probabilística por conveniencia. Los resultados del análisis mostraron que los derechos del niño deben ser priorizados en cualquier instancia, en efecto de acuerdo al estudio se considera que la reforma del artículo 137 del COGEP vulnera el interés superior del niño y genera mayor carga procesal en los juzgados de niñez y adolescencia.es_ES
dc.description.abstractThe personal constraint for non-payment of alimony is a very controversial issue, it is constantly discussed whether the rights of the child should take precedence over those of his or her providers. Therefore, this article analyzes the reform of Article 137 of the General Organic Code of Proceedings to establish its main changes, effects, and the violation of the principie of the best interest of the child. For this purpose, the methodology used is based on a qualitative approach, based on the theoretical foundation, inductive-deductive and comparative methods were employed, as well as resources, such as current legal regulations, bibliographic sources, grounded theory, rnagazines, books, and a non-probabilistic survey by convenience.The results of the analysis showed that the rights of the child should be prioritized in any instance, in fact, according to the study; it is considered that the reform of article 13 7 of the general organic code of proceedings violates the best interest of the child and generates a greater procedural burden in the courts of childhood and adolescencees_ES
