La acción de protección y la precarización laboral en los contratos de servicios ocasionales

Abstract

The objective of this research work was to analyze the protection action in Ecuadorian legislation; evidence of the existence of possible job insecurity within occasional service contracts and the effectiveness of the protection action when it arises due to the violation of constitutional rights within these contracts that occur under the regime of the Organic Law of Public Service. For this, a qualitative approach and a deductive-inductive methodology were used, which allowed us to understand the concepts of the topic addressed by having analyzed the information collected to synthesize it, obtaining as results of this research that; the admissibility of the protection action as it is the appropriate and effective way in the case of occasional service contracts that have been distorted by public sector institutions, which have caused the impairment of the constitutional rights of the plaintiff and therefore that he has been a victim of job insecurity during the duration of the employment relationship he had with the institution in which he worked.
