| dc.description | Esta investigación se centra en determinar si la comunidad de Gualalcay de la Parroquia El Valle, al momento de aplicar su justicia, vulnera el derecho a la integridad personal, según el artículo 66 numeral 3 de la Constitución de la República. Para lo cual se inició con el estudio del ordenamiento jurídico de la legislación ecuatoriana en referencia a la justicia indígena, la misma que se centra en defender y utilizar la ley como un hecho vivo, tratada de manera inmediata, oral donde la cosmovisión, derecho consuetudinario, pluriculturalidad y pluralismo jurídico, contrastan con la Carta Magna. Se identificó y estudió los casos que generalmente resuelve la comunidad, evaluando las sanciones que se impusieron durante el año 2016, llegando a determinar mediante el análisis de la recopilación de casos penales resueltos por la comunidad de Gualalcay, que en dichos casos no se vulnera el derecho a la integridad personal. | es_ES |
| dc.description.resumen | This investigation is focused on determining if the community of Gualalcay, belonged to El Valle parish at the moment of applying its justice, it violates the right of the personal integrity, set out in article 66 (3) of the Ecuadorian Constitution. For doing that, it began with the review of the legal order of Ecuadorian law with reference to indigenous justice which based on defending and utilize the law as a living document or responding immediately, oral, where the Cosmo vision, customary law, the legal multicultural and pluralism contrasts with the Carta Magna. The resolved cases of the community were indentified and studied for evaluating sanctions that were imposed during the year 2016, thereby determining through the analysis of criminal cases resolved by the community of Gualalcay, that in such cases do not violate the personal integrity right. | es_ES |
