dc.descriptionEsta investigación se centra en el análisis de la tenencia compartida con el objetivo de demostrar si es una medida protectora eficaz de los derechos de los niños, niñas y adolescentes garantizando el derecho a la igualdad material y formal de sus progenitores. Se acudió a Derecho comparado indentificado cómo se ha normado el rol de los padres luego de un divorcio. Así mismo, se ha tratado de determinar el alcance de la tenencia de los hijos y si se cumple o no con el principio de corresponsabilidad parental. Siendo ésta una investigación descriptiva, se realizó un análisis de las sentencias de divorcio desde la entrada en vigencia del Código Orgánico General de Procesos (COGEP), esta información se obtuvo de la Dirección de Estudios Jurimétricos y Estadística Judicial del Consejo de la Judicatura del Azuay. Se puede afirmar a primera vista que, el Código de la Niñez y Adolescencia no guarda armonía con el principio de corresponsabilidd parental establecido en la Constitución de la República del Ecuador; por lo tanto, es necesaria una reforma de esta institución jurídica, con miras a garantizar el principio del interés superior del niño; y, que los jueces apliquen aquel mandato de optimización, siendo la tenencia compartida la primera opción cuando los padres se divorcien.es_ES
dc.description.resumenThis research focuses on the analysis of shared tenure with the aim of demonstrating whether it is an effective protective measure of the rights of children and adolescents guaranteeing the right to material and formal equality of their parent. We went to comparative law identifying how the role of parents has been regulated after a diverce. Likewise, an attempt has been made to determine the scope of custody of the children and whether or not the principle of parental responsibility is fulfilled. This being a descriptive investigation, an analysis of divorce judgments was carried out since the entry into force of the General Organic Code of Processes (COGEP), this information was obtaines from the Directorate of Juridical Studies and Judicial Statistics of the Council of the Judiciary of Azuay. It can be affirmed at first glance that the Code of Childhood and Adolescence does not keep harmony with the principle of parental responsibility established in the Constitution of the Republic of Ecuador; therefore, a reform of this legal institution is necessary, with a view to guaranteeing the principle of the best interests of the child; and, that the judges apply that mandate of optimization, being the shared possession the first option when the parent divorce.es_ES
