Análisis de la rehabilitación y reinserción social en el sistema penitenciario como garantías constitucionales en el Ecuador.

Abstract

Social rehabilitation is the starting point for the social reintegration of prisoners once they have served their sentence, based on their rights and Constitutional guarantees. The impact of the prison crisis causes commotion in society, leading to a state of concern, insecurity, and vulnerability, not only in society but also in the prison population. If individuals commit a crime, they must be punished. However, the State must also regulate the purpose and objective of these sanctions, i.e., the sanction is for individuals to repair the damage they have caused, leading them to question their behavior and generating in them the will and intention to remedy and restore the damage and redesign their personality. When inmates are willing to undergo rehabilitation treatment, they can develop their skills and take advantage of all the areas of the regulatory body, including education, work, and training. This offers them the opportunity to develop their abilities and capacities, achieving their reinsertion into society; thus, they will apply everything they have learned and live in harmony and order with the law and society.
