dc.descriptionEl objetivo de la presente investigación se fundamenta en el análisis de la presunta vulneración al Debido Proceso; en la aplicación del artículo 644 inciso 3 del Código Orgánico Integral Penal, en relación a las boletas emitidas por los agentes de tránsito y, que dicho documento, al no ser impugnado en el término legal establecido, se convierta en título de crédito exigible para el presunto infractor, sin que haya alguna resolución firme o sentencia ejecutoriada que certifique el pago. Además, se analiza el procedimiento que ejecutan los agentes de tránsito para levantar las infracciones y el proceso especial de juzgamiento en justicia ordinaria. En este contexto, se aplica el método cualitativo, que permite recopilar información doctrinaria y normativa para realizar un acercamiento teórico sobre el Derecho Penal y Transito; de igual forma, el método deductivo, que ayuda a comprender los antecedentes históricos del Derecho Penal, y posteriormente, centrarse específicamente en las contravenciones de tránsito y finalmente, el método analítico, que permite demostrar con fundamentos, mediante un análisis del artículo 644 inciso 3 del COIP la vulneración a las garantías del Debido Proceso.es_ES
dc.description.abstractThe objective of this investigation is based on the analysis of the alleged violation of Due Process; in the application of article 644 subsection 3 of the Comprehensive Organic Criminal Code, in relation to the tickets issued by transit agents and, that said document, by not being challenged within the established legal term, becomes an enforceable title of credit for the presumed infringer, without there being any firm resolution or enforceable sentence that certifies the payment. In addition, the procedure carried out by traffic agents to lift the infractions and the special process of trial in ordinary justice is analyzed. In this context, the qualitative method is applied, which allows collecting doctrinal and normative information to carry out a theoretical approach on Criminal and Traffic Law; In the same way, the deductive method, which helps to understand the historical background of Criminal Law, and later, focus specifically on traffic violations and finally, the analytical method, which allows to demonstrate with foundations, through an analysis of article 644 paragraph 3 of the COIP the violation of the guarantees of Due Process.es_ES
