dc.descriptionEste trabajo de investigación surge por la necesidad de la aplicación excesiva del principio de oportunidad en las causas penales de esta manera vulnerando a los principios de Seguridad Jurídica y Tutela Judicial Efectiva que son aristas básicas en un ordenamiento jurídico, por ende, se dividió en tres partes: En primer lugar, la fundamentación teórica del principio de oportunidad, definición, origen, su tipificación en la legislación ecuatoriana y el análisis de los requisitos establecidos para su aplicación. En segundo lugar, se estudió los criterios de razonabilidad para comprender la importancia del análisis que debe realizar el agente fiscal en la aplicación del principio de oportunidad, centrándose en el caso concreto para verificar el cumplimiento de las exigencias. Finalmente, analizamos como el uso excesivo del Principio de Oportunidad vulnera derechos y principios establecidos en la norma ut supra como: La Tutela Judicial Efectiva, La Seguridad Jurídica y La Legalidad; porque se encuentran tipificadas las conductas penalmente relevantes, y al no concluir con una sentencia se transgrede también este principio.es_ES
dc.description.abstractThis research paper arises from the need for the excessive application of the principle of opportunity in criminal cases, which violates the principles of Legal Security and Effective Judicial Protection that are basic edges in a legal system. Therefore, it was divided into three parts: First, the theoretical basis of the principle of opportunity, definition, origin, its classification in Ecuadorian legislation, and the analysis of the requirements established for its application. Second, the criteria of reasonableness were studied to understand the importance of the analysis that the fiscal agent must carry out in the application of the principle of opportunity, focusing on the specific case to verify compliance with the requirements. Finally, we analyze how the excessive use of the principle of opportunity violates the rights and principles established in the ut supra standard, such as Judicial Protection, Legal Security, and Legality; because the criminally relevant behaviors are typified and do not conclude with a sentence, this principle is also violated.es_ES
