Análisis de la opinión consultiva CIDH número oc-24/17 frente al matrimonio igualitario

Abstract

The research that is presented under the academic article modality, analyses the Consultative Opinion CDIH Number OC.24/17 in face to the marriage equality, which derives from the vulnerability of the civil rights caused by the constitutional antinomy in the recognition of marriage equality in Ecuador, this is, considering that our country is an active member of the American States Organization. For such end, it was necessary to study its theoretical background derived from the antinomy in function of the 67 article in the Constitution, as well as the negativity to celebrate it in the Azuay province in the judgments of first and second instance of the cases number 01204201803635 and 01204201803637, in respect to the marriage equality, the author concludes that the fastest way to advance on civil rights matter of the people from the LGTBL community would be to reform the subsection two of the 67 article of our Constitution.
