dc.descriptionLa libertad personal se concibe como un derecho fundamental sobre todo en un Estado constitucional de derechos y justicia y privar al hombre de su libertad sería degradarlo, por tal motivo, la libertad se consagra en la mayor parte de ordenamientos jurídicos como uno de los bienes jurídicos de mayor importancia después del derecho a la vida. Por esta razón, a través de la presente investigación, el autor realiza un análisis exhaustivo respecto a la aplicación de las medidas cautelares, en especial, a la justificación que debe fundar Fiscalía General del Estado y el criterio que debe tener en consideración el Órgano Jurisdiccional para aplicar la prisión preventiva. Debido a que, para limitar este derecho, se deberá verificar el cumplimiento irrestricto tanto de los requisitos como de los presupuestos establecidos en el marco procesal penal y por supuesto comprobar si estas premisas guardan armonía con aquellas disposiciones previstas en la Constitución ecuatoriana y los instrumentos jurídicos internacionales respecto a los derechos del ser humano y si estas disposiciones son respetadas y aplicadas por quienes administran justicia en el Ecuador.es_ES

For this reason, through the present investigation, the author carries out an exhaustive analysis regarding the application of precautionary measures, especially, the motivation that must be founded by the State Attorney General's Office and the criteria that the Jurisdictional Body must take into account. to apply pretrial detention.
