Resumen
"This paper aims to analyze the criminal offense under Art. 146 of the comprehensive Criminal Code, this refers to the penalties deriving from Wrongful in al occupations, also contributes with input from itemization in the penalty area in reference to medicine, and therefore there is a balance for both the patient and the doctor, including medical protocols, and a specific criminal regulating medical malpractice.
Wrongful death is defined, its elements, guilt and its diverse forms, objective duty of care, the history of medical malpractice, professional activity of doctor with patient.

"El presente trabajo tiene el objetivo de analizar el tipo penal tipificado en el Art. 146 del Código Orgánico Integral Penal, este se refiere a las sanciones que deriva del Homicidio Culposo en todas las profesiones, además contribuir con aportes de particularización en el área penal en referencia a la medicina, y por ende que exista un equilibrio tanto para el paciente como para el médico, incluyendo protocolos médicos, y un tipo penal específico regulando la mala práctica médica.
Se define el homicidio culposo, sus elementos, la culpa y sus distintas formas, el deber objetivo de cuidado, los antecedentes de la mala praxis médica, la actividad profesional del médico con el paciente.
