| dc.description | En el presente trabajo se realizó un análisis minucioso de los problemas frecuentes que existen con respecto al manejo de la prueba ilícita indebidamente actuada que contravienen el manual de cadena de custodia en el primer semestre del año 2017 en la ciudad de Cuenca, este estudio se centró tomando en consideración la dogmática jurídica que existe entre la recolección y conservación de las evidencias, del mismo modo se consideró la problemática que genera la producción indebida de la prueba ilícita dentro del proceso penal. Todos estos estudios dieron como resultado que el manejo de la prueba ilícita indebidamente actuada dentro del proceso penal es inconstitucional por cuanto la recopilación y manejo de las evidencias tienen un camino a seguir y este camino es la cadena de custodia que de ninguna manera se puede omitir. | es_ES |
