Análisis sobre la denominación de signos distintivo y nombres comerciales en el Ecuador

Abstract

The objective of this research is to analyze and propose the differences between Distinctive Signs and Company Names, to establish these differences, it is necessary to understand the Intellectual Property; to know its history in brief, know the various treaties, and conventions that regulate the Intellectual Property; this way, to establish the aforementioned differences is necessary to study the functions and the requirements needed to obtain the registration of both Distinctive Signs and Company Names based on a clear definition of the concepts, their legal nature, and characteristics. Similarly, the unfair competition will be discussed, as it is regulated and defined, which are considered acts of unfair competition as well as what type of actions should be taken against them, all this, according to the current regulations in our legal system, the same that will be developed in this research work
