Resumen
The objective of this research was to identify the problem that is generated by the
absence of the form in which the right to alimony in favor of the spouses should be
regulated, so that within this work the need to implement within the Ecuadorian
regulations a table of pensions for congruent alimony for the benefit of the spouses
was analyzed in order to avoid the possible violation of the right to alimony and the
right to a decent life, indicating that within the Civil Code determines that alimony is
not only for children and adolescents, but also for the spouse. As well as identifying
the components, requirements and advantages of the implementation of the table of
alimony, due to the fact that currently in Ecuador the economic value to be set for
alimony for the benefits of the spouses is the same value imposed for children and
adolescents, bringing as a consequence a violation of the right to food and the right
to a dignified life of the applicant spouse.

El objetivo de la presente investigación fue identificar la problemática que se genera
por la ausencia de una tabla de pensiones alimenticias que regule el derecho a
alimentos a favor de los cónyuges, de tal forma que dentro del presente trabajo se
analizaron los componentes principales y la necesidad de implementar dentro de la
normativa ecuatoriana una tabla de pensiones para alimentos congruos en beneficio
de los cónyuges con la finalidad de evitar la posible vulneración al derecho de
alimentos y al derecho a una vida digna, indicando que dentro del Código Civ
determina que se beben alimentos no solo a los niños, niñas y adolescentes, sino
también al cónyuge.
