Ítem Acceso Abierto Aplicabilidad del principio de insignificancia en la punibilidad de las contravenciones penales de segunda, tercera y cuarta clase de los Arts. 394 al 396 del COIP(Universidad Católica de Cuenca., 2021) Palacios Palacios, Santiago Vinicio; Torres Wilchez, Marcelo Urbano; 0104804117In this research, an analysis of the punishability of the criminal offenses indicated in Articles 394 to 396 of the Comprehensive Organic Criminal Code (COIP, in Spanish) is made, which are punishable by deprivation of liberty because in the Principle of insignificance, according to the doctrine and national and international jurisprudence, the excessive criminality in these offenses is evidenced. To this end, methods, such as exploratory, analytical, inductive, and documentary review of laws, doctrine, and national and international jurisprudence have been used. Through the study, it has been posible to determine that there is a violation of the Principle of Insignificance within the criminal offenses contained in the COIP from Art. 394 to 396 since being considered in the doctrine as petty crimes in other legislations such as Argentina, Peru DQG&RVWD 5LFDthe penalti of imprisonment is excessive to the non-existent seriousness of theoffense. Consequently, and as a personal contribution, a comparative review is made on the punishment of misdemeanors in other Latin American countries, which apply the principle of in significance in their penal codes.
