In order to analyse the production in companies that produce plastic objects and the possible violation of the right to nature as established in Ecuadorian legislation, an exploratory and descriptive type of research was carried out, using a qualitative approach to collect and analyse information from jurisprudence and doctrine on the rights of nature, comparative law and interviews with jurists. As part of the findings, there is legislation in the region that regulates the use of single-use plastics. Thus, the analysis of the declarations of state of exception that were made during this period of government and that were the subject of research determined that this figure was used to overcome crises that developed due to the government taking economic measures and to counteract the spread of the Covid-19 virus where the figure of state of exception was used excessively by the executive, which despite the fact that it could resort to ordinary bodies did not do so and resorted to extraordinary mechanisms. There are both national and international regulations that establish the requirements to declare a state of exception, despite these regulations have not been complied with and there has been the omission of some requirements contemplated in the law, in addition to the fact that the grounds to make use of this figure is not the correct one and before this it can be evidenced that there is not a correct control by the Constitutional Court, which is the competent body to determine the constitutionality of the states of exception once the grounds and foundations used in it have been gradually analyzed.Ítem Solo Metadatos Análisis del derecho a la tenencia, frente a la presunta vulneración del derecho de igualdad de los progenitores.(Universidad Católica de Cuenca., 2022) Ordoñez Sisalima, Juan Mateo; Fajardo Romero, Carlos Julio; 0105474886Within the legal regulations of Ecuador, the principle of the right to equality is typified, coming to strictly establish that every person is equal and must enjoy the same rights and duties, therefore no one can be reached to violate this right because of their gender, ethnicity, sex, age, etc. The Ecuadorian Magna Carta recognizes and seeks to guarantee all cities the right to equality in its different types (equality in form, material) eliminating discrimination. Then under the previous precise, in the state there should be no contrary regulations, such as the one declared unconstitutional being Art. 106 of the Code of Childhood and Adolescence specifically in its numerals 2 and 4, where a preference between man and woman can be evidenced (father-mother) to implement custody and parental authority. With the above, the following article seeks to analyze in a critical-legal way, how the maternal preference in relation to the possession of children comes to violate the right of legal equality between male parents, thus being able to demonstrate the influence of gender before the law and the principle of equality. From this analysis, it is concluded that the application of the right of repetition involves difficulties, ranging from the lack of clarity in the legal norms that regulate it, to the determination of liability for gross negligence or malice of public servants or former public servants, in observance of the presumption of innocence, as a fundamental guarantee of due process. The hypothesis is that, despite regulations and public policies promoting the right to inclusive education, various regulatory and institutional factors hinder the practical realization of this right. The analysis aims to explore the constitutional and infra-constitutional provisions that guarantee the right to education for students with disabilities in higher education, as well as to examine the coherence and relevance of these norms with the particular needs of these students. It is concluded that, despite regulatory and political advances, discrimination and violation of the rights to education of individuals with disabilities are evident and have economic, labor, and social participation repercussions. The objective of this article is to analyze the principle of specialty and its violation according to the Organic Code of the Judicial Function in cases of jurisdictional guarantees that are resolved by judges who do not have such specialty to resolve such processes.
