    Social Rehabilitation in Ecuador is a fundamental right that must be guaranteed by the State; however, despite the advances in regulations, this has not been enough to comply with it in practice. The population deprived of liberty is increasing and the current conditions show that there is a total incapacity of the government administration. Overpopulation is one of the problems that the Penitentiary System is obliged to solve since because of this there is a triggering of violation of rights such as health, education, personal integrity, among others. This research work gathers legal dogmatic elements that address the non-compliance of the State concerning the right to Social Rehabilitation; this undoubtedly triggers a growing rate of recidivism in the commission of crimes, resulting in traffic of entry and exit of prisoners from each Social Rehabilitation Center. Likewise, a survey of information was carried out in the Center of Deprivation of Liberty for Adult Offenders of Archidona in Napo, which ended up reflecting that there is a violation of the rights of the PPL given that each of the axes of treatment contemplated in the national legislation is not complied with integrally.
