Ítem Acceso Abierto La problemática Jurídica por la violación de los principios de Celeridad y Economía procesal a consecuencia de la reforma del Código Orgánico General de Procesos en relación al apremio personal en materia de niñez y adolescencia(Universidad Católica de Cuenca., 2021) Vega Valencia, Lizeth Carolina; Barrera Bravo, Fausto Ricardo; 1900805415The following investigation determines that the regime of personal constraint established in Article 137 of the General Organic Code of Processes (COGEP, in Spanish), flagrantly violates the constitutional principles of economy and procedural speed, especially through the establishment of the hearings for the review of measures of constraint, the holding of which has saturated the Ecuadorian justice system. This study includes three defined areas: first, it conceptualizes the right to food, the enforcement by committal on food, and the constitutional principles of speed and procedural economy; second, it legally determines the effects of Article 137 of the General Organic Code of Processes concerning the enforcement by committal on food; and third, it analyzes possible legal alternatives to improve the speed and procedural economy of trials in which the food provider is late in paying one or more alimony.
