In this research work an analysis of the violation of the Constitutional Principle of Contradiction in the probative independence of the reports of public servants that are generated within an action governed by the Administrative Penalty Procedure is carried out. In this sense, we will study this legal problem that is especially detrimental to the administered, since the reports signed by public servants are elevated to independent evidence at the investigation stage and therefore the authority that directs the administrative investigation prevents exercise to the parties their right of contradiction orally as determined by the Constitution and the Law, ask and cross-examine the grounds that served as the basis for their pronouncement, that is, calling for the support of those servers who issued them, thus violating the legitimate right of contradiction guaranteed in the Constitution
