Ítem Acceso Abierto La compra - venta ficta para ocultar bienes con el fin de no pagar una obligación(Universidad Católica de Cuenca., 2021) Villafuerte Guevara, Jean Pierre; Valarezo Cordero, Juan Fernando; 1500605371This research work analyzes the figure of the fictitious sale and purchase as an unfair practice to hide the debtor's assets in order not to pay his debts and the figure of the Paulian action, since this would watch over the interest of the creditors. The main objective is to analyze the fictitious sale and purchase contracts in relation to the concealment of goods in order to determine if they are used as a tool to avoid paying the obligations through the study of the rules that regulate contracts, based on a legal and doctrinal study of the different acts and contracts, the vices of consent, and the Paulian action. Likewise, a deep revision is made on the nullity of civil acts between individuals, especially the contract of sale. Subsequently, it is carried out an analysis of the General Organic Code of Proceedings for the nullity of a sale contract and actions such as the Paulian for the protection of creditors against concealment through the purchase-sale.
