Under this background, it is worth mentioning that if it is decided to execute a wrongful dismissal of a person with disabilities or the person responsible for the care of the person with disabilities, he/she must be compensated with a value equivalent to eighteen months of their best remuneration, plus the corresponding legal indemnity. So that this precept becomes a reality, the person wrongfully dismissed must comply with certain requirements, one of which is indispensable, such as the disability card issued by the MSP, and another irrelevant one, which is the qualification and certification of substitute worker. The lack of this second requirement does not make him/her worthy of the special remuneration mentioned above, with the development of this research it will be demonstrated that this requirement can be supplied only by the disability card of the person in charge of the worker.
