- ÍtemAcceso AbiertoDerecho a la vida digna de las personas que sufren enfermedades crónicas degenerativas, mediante el testamento anticipado o vital dentro del marco jurídico ecuatoriano(Universidad Católica de Cuenca., 2023) Pesantez Muñoz, Amelia Gabriela; Lalvay Sanchez, Patricia Jhomayra; Culcay Villavicencio, Iván; 3050127707; 0106680622The living will is a legal document that enables individuals with chronic degenerative diseases to communicate their preferences for medical care, which is particularly important due to the progressive loss of decision-making capacity associated with such conditions. This document allows people to express their will by stating their limitations and preferences regarding medical treatment when they can no longer do so. Moreover, living will alleviates the emotional burden on the patient's family and facilitates decision-making for medical professionals, thus avoiding potential disputes. The living will plays a crucial role in upholding the principle of autonomy and promoting respectful and compassionate care. This study uses the historical-logical method, analyzing bibliographies, theories, and laws to establish the need to incorporate advance directives' living will into the Ecuadorian Legal System, ultimately ensuring better protection of the right to life with dignity of people suffering from chronic degenerative diseases.
