Ítem Acceso Abierto Análisis de las razones en los casos de negativas de inscripción en el Registro de la Propiedad del cantón Cuenca(Universidad Católica de Cuenca., 2018) Padilla Balarezo, Luis Alberto; Culcay Villavicencio, Iván Patricio; 0105813661In the current research work it is determined if at the moment of making the registry qualification, there was an adequate application to the Law, with the objective of carrying out an analysis of the foundation issued by the Property Register of Cuenca canton in each return note of registration, the importance of the motivation in each devolution is determined, consisting of reasoning of fact and law, containing critical, logical and valuable elements. Through an analysis made to the return notes, included in February 2018, it was determined that several return notes do not comply with the requirement established by the Constitution, regarding to the motivation, at which it is proposed to the Property Register to take into account the returnable that it issues, to the users to claim the breach of the norm and the arbitrariness itself, so it should be considered null some return notes.
