- ÍtemAcceso AbiertoLa Mediacion laboral a traves de medios telematicos en los procedimientos efectuados ante el inspector de trabajo, como un recurso para garantizar los derechos del empleador y trabajador en el Ecuador.(Universidad Católica de Cuenca., 2022) Pérez Jiménez, María Alicia; Torres Luzuriaga, Camila Alexandra; Ochoa Rodriguez, Fernando Esteban; 0704413707; 0107196115; Ordoñez Carpio, Fernando EstébanMediation has emerged as an alternative conflict resolution procedure, where, unlike ordinary justice, it proposes peaceful management of controversies. Likewise, in the labor area, mediation allows employers and workers to settle their problems safely and peacefully without needing costly litigation, where one of the parties loses. On the other hand, the Covid-19 pandemic forced the Ecuadorian State to accept the possibility of processing mediation processes by digital media, such as video calls, relying on other tools such as electronic signatures. The general objective of this paper is to establish whether the normative regulation allows telematics labor mediation to solve employment conflicts in the Ministry of Labor through its inspectors. This objective is achieved through documentary techniques and methods such as analytical, synthetic, deductive, and exegetical.
