Ítem Acceso Abierto Análisis técnico jurídico de la adhesión al sistema Ciadi y sus implicaciones en los procesos de negocio en el Ecuador.(Universidad Católica de Cuenca., 2023) Morocho Peñafiel, Geovanny Fernando; Alarcón Vélez, Ricardo Agustín; 0923640957The International Center for the Settlement of Investment Disputes, ICSID, is a facilitating body for the negotiation and resolution of disputes related to productiveinvestment between countries in an impartial framework. Ecuador was a member of ICSID since 1986, this being an irregular approval, in 2001 the agreement with this institution was ratified. However, in the face of disputes over hydrocarbon sector issues and with the entry of a National Constituent Assembly and, consequently, a new Constitution, Ecuador disassociated itself from ICSID in 2008. Currently there is already a ratification carried out only by the executive, with questions on the constitutionality of the same, and even more, what will be the legal and economic effects for Ecuadorians,after the subscription. This research aims to identify the benefits and disadvantages of Ecuador's accession to the ICSID system and its implications in business processes, what isthe legal and economic impact for Ecuadorians in the framework of international relations. Likewise, we will conclude what repercussions the disassociation with this organization has brought to our country for twelve years.
