Ítem Acceso Abierto Análisis de la eficacia de los mecanismos de reparación integral de las víctimas del delito de estafa(Universidad Católica de Cuenca., 2023) Matute Peralta, Lilia Priscila; Monsalve Robalino, Xavier Bernardo; 0105716377Throughout the history of law, fraud has been considered a crime that requires the concurrence of four essential elements: deception, error, victim, and damage. This paper analyzes sentences related to the mechanisms of integral reparation in cases of swindling using a qualitative methodology that synthesizes realities to understand their essence; for this reason, four sentences related to this crime were studied to examine the effectiveness of the mechanisms of integral reparation and the implementation of the corresponding measures. The results obtained revealed that the effectiveness of such mechanisms varies according to the case and the implementation of the corresponding measures. It is therefore necessary to strengthen the capacity of the institutions in charge of justice and comprehensive reparation to provide an adequate response to victims of fraud crimes. It is essential to highlight that these reparation mechanisms are part of an agreement reached between the Attorney General's Office and the defendant's defense in the framework of an abbreviated procedure.
