Ítem Solo Metadatos La afectación al derecho de la tutela efectiva, por la aplicación de la ordenanza del GAD del cantón Quito, en la regularización de bienes mostrencos(Universidad Católica de Cuenca., 2023) Pilaguano Cruz, Luis Germán; Luzuriaga Torres, Nelly Concepción; 1709688251The vulnerability to effective judicial protection is the procedure for awarding urban properties under the modality of non-disposable property, it is one of the serious problems faced by the Decentralized Autonomous Govermment of Quito. The objetive of this research is clarify the prejudices caused by not determining that there is an specific ordinance that regulate and legalizes in the establish times the properties that do not have a property owner. The investigation had a mixed approach with a focus on qualitative research, method such as inductive, deductive, logical, analytical, synthetic and historical were used. Consequently in this research the Infringement of the Right to Judicial Protection was evidenced by the Decentralized Autonomous Govermment of the Quito in order to regularize the properties that do not have a domain owner. Finally the proposal to solve this, is to regulate acces tol and ownership as posible.
