Ítem Acceso Abierto La inaplicabilidad del artículo 178 del Código Orgánico Integral Penal en la difusión de videos sexuales filmados con consentimiento de la víctima(Universidad Católica de Cuenca., 2021) Loyola Cazorla, Pedro Esteban; Torres Wilchez, Marcelo Urbano; 0105468839In the following qualification work, the scope of article 178 of the Comprehensive Organic Criminal Code is analyzed to determine who may be subject to sanction for the crime of violation of privacy due to the dissemination of sexual videos, in addition to defining the requirements of paragraph 178 of the COIP to determine the requirements that make up the classification of this crime and the mechanisms that victims have against computer crimes Within this analysis, the existence or not of a violation of the right to privacy will be verified based on international and national regulations that supports the privacy of all people in order to protect their personal data and their intimate sphere, finally through the investigative methods corresponding to the qualitative research approach of a descriptive and documentary nature, it will be known if it is necessary to propose a reform to section 178 of the COIP in order to protect the right to privacy.
