The problem arises from the regulations outlined in the Regulations of the Organic Code of Management of Identity and Civil Data, which determines that adolescent parents must be accompanied by a legal representative during the process of registering their children’s birth. The cases contained in Constitutional Court Ruling No. 2185-19JP AND ACCUMULATED/21 have been studied to highlight the existing problem and how only a select group of unaccompanied adolescent mothers, through legal proceedings, have been able to obtain legal remedies for the violation of their children’s rights, mainly their right to identity. It was determined that the subjects of this study —namely the unaccompanied adolescent mothers— face a situation of dual vulnerability. They are part of a group that requires special attention, as they are children and adolescents, and they are further disadvantaged due to a situation of human mobility. Newborns, who also belong to the same priority group, are additionally affected by the circumstances surrounding their parents, regardless of their own migrant status.
