- ÍtemAcceso AbiertoAnálisis de la inserción de ayuda prenatal como parte de las cargas familiares del alimentante dentro de un incidente de rebaja de pensión de alimentos(Universidad Católica de Cuenca., 2023) Floreano Lainez, Joselyn Denisse; Culcay Villavicencio, Iván; 2450342338The research aimed to demonstrate the current need in the Ecuadorian legal system to regulate prenatal care as a family burden within the incidents of alimony reduction since now the current regulations only make it possible to file a motion when there are new family dependents. This means that only the born children will receive the support paid by the alleged father on behalf of the pregnant woman. The judges do not consider the expenses the pregnant woman may have periodically within the previously set alimony, which reduces the economic capacity taken as a reference to establish the original payment. The study has concluded that such a fact is illogical since the same law contemplates the pregnant woman as the holder of the right to alimony, established in article 148 of the aforementioned normative body. For this reason, pregnant women should be considered as a family burden within incidents of reduction of the alimony to avoid detriment to the right to defense and a dignified life of the breadwinner. Aqualitative-quantitative research was used to approach the subject matter from a doctrinal and normative study, which was complemented by a field investigation through the application of surveys to a certain group of legal professionals
