Ítem Acceso Abierto "Análisis de la vulneración a los derechos de los menores en los procesos de maternidad subrogada por vacíos legales en el marco normativo ecuatoriano "(Universidad Católica de Cuenca., 2022) Crespo Bravo, Ana Isabel; Sánchez Zambrano, José Santiago; 0303101240Over the years, human beings have been characterized by reproducing their species with the purpose of generating an offspring that will last, configuring the right to conceive as a fundamental right inherent to the nature of people. However, it is well known that not all subjects can procreate, due to pathological circumstances beyond their control, and some human beings find themselves in a situation that makes it impossible to conceive in the real world. Thus, science has presented solutions through Assisted Reproduction Techniques, being one of them, surrogacy or surrogate wombs. However, this practice has generated controversy worldwide, because not all countries in the world accept it, and others do not have a specific regulation within their legislation. In consequence, there is a legal vacuum that derives in a direct violation of the minors’ rights who are born by surrogacy practices, since the legal and material consequences that result from the legal business of maternal surrogacy, produce an affection to the rights of the children due to the lack of regulation of these scientific practices in the physical world. Therefore, this research has the objective of studying surrogate motherhood in relation to the violation of the minor’s rights, in order to determine the scope of this problem, within the Ecuadorian legislation.
