The regulations establish a distinction between the public employees responsible for administrative and representative functions, granting them a 30-day vacation period, while in private practice, workers who contribute to activities in which the State does not participate receive 15 days of vacation right. The objective of this study is to demonstrate the existence of a differentiated treatment between public and private employees. First, the legal regulations of the different conceptions in Ecuadorian legislation regarding the right to work and the right to vacation in the public and private regimes are analyzed. Secondly, a comparative study is carried out of Colombian, Chilean, and Mexican legislation on annual vacations for public and private employees in these countries. Thirdly, the violation of the principle of equality of private employees will be determined since there is a disparity in the number of days established in the Labor Code regarding the right to annual vacations, considering that everyone should receive the same benefits since they are equal under the law.
