These unlawful acts can be motivated by various factors, such as social, family, or emotional ones, driven by a desire for financial gain or simply to cause harm. The State has established that minors cannot be judged like adults for this issue. Consequently, adolescent offenders must undergo legal procedures and specific rules that apply to their age. Likewise, the law protecting children's and adolescents' rights stipulates that they will not be subject to custodial sentences but will be subjected to socio-educational measures to rehabilitate young offenders and reduce the likelihood of recidivism. To examine this problem, a bibliographic-documentary methodology was employed based on the doctrine analysis, national and international regulations, international treaties, and conventions. This research also applied the Historical-Logical method to analyze bibliographies, theories, and laws. It was established that the prevailing social reality demonstrates that the flexibility of socio-educational measures contributes to the persistence of recidivism in our society.
