Ítem Solo Metadatos Análisis de la posible vulneración al debido proceso con la aplicación del inciso 3-art 644-código orgánico integral penal(Universidad Católica de Cuenca., 2023) Campoverde Figueroa, Alexander Daniel; Panamá Vintimilla, Marcos Antonio; Clavijo, Santiago; 0105639140The objective of this investigation is based on the analysis of the alleged violation of Due Process; in the application of article 644 subsection 3 of the Comprehensive Organic Criminal Code, in relation to the tickets issued by transit agents and, that said document, by not being challenged within the established legal term, becomes an enforceable title of credit for the presumed infringer, without there being any firm resolution or enforceable sentence that certifies the payment. In addition, the procedure carried out by traffic agents to lift the infractions and the special process of trial in ordinary justice is analyzed. In this context, the qualitative method is applied, which allows collecting doctrinal and normative information to carry out a theoretical approach on Criminal and Traffic Law; In the same way, the deductive method, which helps to understand the historical background of Criminal Law, and later, focus specifically on traffic violations and finally, the analytical method, which allows to demonstrate with foundations, through an analysis of article 644 paragraph 3 of the COIP the violation of the guarantees of Due Process.
