- ÍtemAcceso AbiertoEl principio de mínima intervención penal como límite del IUS Puniendi del Estado Ecuatoriano(Universidad Católica de Cuenca., 2020) Calle Romero, Mayra Lourdes; Hidalgo Flores, César Felipe; 0105800601With the 2014 penal reform, the Ecuadorian penal system was transformed from an inquisitive to an accusatory system, where the punitive power of the State should have been limited by a series of procedural principles that govern the criminal process in order to guarantee the rights of victims and persons suspected or prosecuted for a violation. Given this regulatory evolution, it is appropriate to analyze the scope of the principle of minimum criminal intervention within the current regulations as well as in the reform that will enter into force in June 2020, so that it can be determined that applying it, would limit the punitive power of the State. To achieve this goal, a doctrinal, regulatory and jurisprudential analysis of the principle of minimum intervention in current criminal legislation is carried out, as well as in the reform approved in December 2019.
