- ÍtemAcceso AbiertoLa interpretación dinámica o evolutiva como mecanismo para el reconocimiento del derecho a la muerte digna en el Ecuador(Universidad Católica de Cuenca., 2021) Cárdenas Herrera, María Luisa; Vázquez Calle, José Luis; 0302711726; ., .The dynamic or evolutionary interpretation, being an interpretative method that is responsible for understanding the norm from a broader context that connects the need for normative change with social reality, allows adapting the rights protected in the Constitution at present time, therefore, this research aims to establish the method of evolutionary interpretation as the appropriate mechanism for the recognition of the right to a humane death in Ecuador, understanding for the effect of it as a meaning that includes euthanasia and medically assisted suicide. Hence, this work has employed a qualitative approach, as well as historical-logical methods that analyze the origin and evolution of the evolutionary interpretation, inductive-deductive that starts from a general approach to a particular and dogmatic one, which includes a thorough literature review that has led to the critical analysis of doctrine, jurisprudence and the legal system in order to justify the recognition of the right to a dignified death through the evolutionary interpretation. In this context, the results obtained show the importance of this interpretative method in the recognition of rights, the need to implement the right to a dignified death in Ecuador, and the evolutionary interpretation as the appropriate mechanism for this purpose. Additionally, it was found that the recognition of this right through other procedures would not be feasible, thus determining the viability of evolutionary interpretation for this purpose.
