It began with the reform of the Organic Integral Criminal Code to protect women's lives. This is a way to eradicate gender-based violence; however, this criminal offense has caused a number of problems because it is poorly specified in terms of its aggravating circumstances. Femicide is defined as the murder committed by a person against a woman; it can happen in many circumstances, but all go to the same point, namely, gender reasons. Therefore, it was necessary to analyze in depth what corresponds to the crime of femicide in a way that allows all the characteristics of this crime to be known. A deep analytical research, along with the qualitative method, allowed to determine what is the relationship among the constitutional principles that govern within a criminal case and focus on the respective principle of proportionality. Thus, the purpose of the research was to analyze in depth whether sanctioning the offense of femicide violates this principle, —established in the Constitution in Art. 76, item 6—.
