The case of Nelson Serrano, an Ecuadorian sentenced to death in Florida in 2006, was heard by the Inter-American Commission on Human Rights (IACHR) on two occasions. In 2008, the Commission issued a favorable report with recommendations that have not been fully fulfilled. Since the 2008 Constitution in Ecuador, there has been a constitutional guarantee of action for non-compliance, established as a mechanism for fulfilling judgments or reports of international human rights bodies. However, despite the existence of this guarantee, the recommendations issued by the IACHR, in this case, have not been fully complied with. This suggests that, even with a body of norms that demands compliance with the recommendations, there may be other obstacles that impede their full execution. This study analyzes the Ecuadorian legal framework to determine how this action guarantees compliance with the Inter-American Commission on Human Rights recommendations. The constitutional guarantee is proposed as formally viable for the case under study, considering the hierarchy of international human rights instruments, the principle of direct application of international conventions, and the material concept of the Constitution.
